Can an Indian company file a US trademark?
Yes. Businesses based outside the US can file with the USPTO, but foreign-domiciled applicants must be represented by an attorney licensed in the United States. We coordinate this for you.
Do I need to be selling in the US to file?
No. You can file on an intent-to-use basis and submit a Statement of Use once you start selling, or file based on your home-country registration.
How long does a US trademark take?
It often takes a year or more from filing to registration, depending on USPTO workload and whether an office action is issued.
How long does a US trademark last?
It can last indefinitely if maintained. Maintenance filings are due between years 5 and 6, and renewals every 10 years.
Can I use ยฎ in the US before registration?
No. You can use โข while the application is pending; ยฎ is only allowed after USPTO registration.
